Scope of Services

Dive Kultura is an online platform that allows users to discover, book, and pay for diving-related activities. We act as a booking intermediary between you and Service Providers. All diving services are provided by licensed and qualified operators, not directly by Dive Kultura, unless otherwise stated.

Eligibility

You must:

  • Be at least 18 years old to make a booking.

  • Be physically and medically fit to participate in diving activities.

  • Possess required diving certifications (if applicable).

  • Comply with all local laws, safety rules, and Service Provider requirements.

Bookings and Payments

  • Bookings are confirmed only upon full or partial payment as indicated at checkout.

b. By Service Provider or Dive Kultura

  • If the dive is cancelled due to bad weather, safety concerns, or unforeseen circumstances, you will be offered a full refund or the option to reschedule.

Refunds will be processed within 7–14 business days.

Health and Safety

  • Diving involves inherent risks, including injury or death.

  • You must complete a Medical Declaration Form and may be required to present a physician’s clearance before diving.

  • Service Providers reserve the right to refuse participation if they believe it may endanger your safety or the safety of others.

Assumption of Risk and Liability Waiver

By booking through Dive Kultura, you acknowledge that:

  • You voluntarily assume all risks associated with diving activities.

  • Dive Kultura is not liable for injury, loss, or damage caused by your participation, except in cases of proven gross negligence or willful misconduct on our part.

  • You agree to release, indemnify, and hold harmless Dive Kultura and its affiliates from any claims arising from your participation.

User Responsibilities

You agree not to:

  • Make fraudulent bookings or use the Website for unlawful purposes.

  • Interfere with the security or functionality of the Website.

  • Violate any applicable local or international laws.
